Agreement to Terms

By accessing or using Fina ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

Account Registration

To use certain features of the App, you must create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain the security of your account credentials
  • Promptly update your account information if it changes
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use of your account

Acceptable Use Policy

You agree not to:

  • Use the App for any illegal or unauthorized purpose
  • Attempt to gain unauthorized access to the App or its systems
  • Interfere with or disrupt the App's functionality or servers
  • Upload malicious code, viruses, or harmful content
  • Abuse or spam the AI features or API services
  • Share offensive, inappropriate, or harmful content
  • Impersonate another person or entity
  • Collect or harvest data from the App without permission
  • Use the App to compete with or create a similar service
  • Reverse engineer, decompile, or disassemble the App

AI-Generated Content

Fina uses artificial intelligence to generate vocabulary lessons and conversation responses. You acknowledge and agree that:

  • AI-generated content may contain errors or inaccuracies
  • You should verify important information independently
  • We do not guarantee the accuracy or completeness of AI content
  • AI responses are for educational purposes only
  • You use AI-generated content at your own risk

Educational Disclaimer: Fina is designed for language learning and educational purposes. While we strive for accuracy, always verify critical information with authoritative sources, especially for professional or academic use.

Intellectual Property

The App and its original content, features, and functionality are owned by Fina and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain ownership of content you create (custom vocabulary topics, feedback, custom scenarios), but grant us a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, modify, and display that content solely to provide and improve our services.

User-Generated Content

When you create custom vocabulary topics, provide feedback, or submit content to the App, you represent and warrant that:

  • You own or have the right to use the content
  • The content does not violate any third-party rights
  • The content does not contain illegal or harmful material
  • You grant us permission to use the content as described above

We reserve the right to remove any user-generated content that violates these Terms or is otherwise objectionable.

Subscription and Billing

Fina offers both free and paid subscription tiers:

  • Free Trial: New users receive a 7-day free trial with full access to premium features
  • Paid Subscription: After the trial, a paid subscription is required for continued access to premium features
  • Billing: Subscriptions are billed through the Apple App Store
  • Auto-Renewal: Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
  • Cancellation: You can cancel your subscription at any time through your Apple App Store account settings
  • Refunds: Refunds are handled according to Apple's refund policy

Managing Your Subscription: To manage or cancel your subscription, go to Settings → [Your Name] → Subscriptions on your iOS device, or use the Customer Center in the app.

Service Availability

We strive to provide reliable service but cannot guarantee that the App will be available at all times. The App may be temporarily unavailable due to:

  • Scheduled maintenance or updates
  • Technical issues or server problems
  • Third-party service interruptions
  • Force majeure events beyond our control

We are not liable for any interruptions, data loss, or damages resulting from service unavailability.

Limitation of Liability

To the maximum extent permitted by law, Fina and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of profits or revenues
  • Loss of data or information
  • Loss of business opportunity
  • Loss of goodwill or reputation
  • Any other intangible losses

Our total liability for any claims arising from your use of the App shall not exceed the amount you paid to us in the 12 months preceding the claim.

Important: Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

Indemnification

You agree to indemnify, defend, and hold harmless Fina and its officers, directors, employees, agents, and affiliates from any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

  • Your use or misuse of the App
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your user-generated content

Account Termination

You may delete your account at any time through the App settings (Profile → Account Settings → Delete My Account). Upon deletion:

  • Your right to use the App will immediately cease
  • Your data will be permanently deleted within 30 days
  • Your subscription will be canceled (no refund for unused time)
  • You will lose access to all progress and user-generated content

We reserve the right to suspend or terminate your account if you:

  • Violate these Terms
  • Engage in conduct harmful to other users or the App
  • Use the App for illegal purposes
  • Abuse or misuse the service

Third-Party Services

The App uses third-party services to provide certain features:

  • Supabase: Backend services and data storage
  • Chutes AI (Kokoro): Text-to-speech for pronunciation
  • Qwen/Qwen2.5-72B-Instruct: AI vocabulary generation (default)
  • Google Gemini: AI conversation and vocabulary (optional fallback)
  • RevenueCat: Subscription management

These services have their own terms and privacy policies. We are not responsible for the actions, policies, or practices of third-party service providers. Your use of these services through our App is subject to their respective terms.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by:

  • Posting the updated Terms in the App
  • Updating the "Last Updated" date at the top
  • Sending an in-app notification for material changes

Your continued use of the App after changes are posted constitutes acceptance of the modified Terms. If you do not agree to the new Terms, you must stop using the App and delete your account.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of California, without regard to its conflict of law provisions.

Dispute Resolution

Any disputes arising from these Terms or your use of the App shall first be resolved through good faith negotiations. If negotiations fail within 30 days, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

You agree to arbitrate disputes on an individual basis only. You waive any right to participate in a class action lawsuit or class-wide arbitration.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Fina regarding your use of the App and supersede all prior agreements and understandings.

No Waiver

Our failure to enforce any provision of these Terms shall not be construed as a waiver of that provision or our right to enforce it in the future.

Assignment

You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign these Terms without restriction.
